VPS Acceptable Use Policy

This Acceptable Use Policy ("Policy") outlines the terms and conditions for the use of Virtual Private Server ("VPS") services provided by Archous Networks Inc. ("Provider"). By using the VPS services, you ("Client") agree to comply with this Policy.

1. Legal Use of VPS Services

1.1 Compliance with Laws: The Client agrees to use the VPS services in compliance with all applicable laws and regulations.

1.2 Responsibility for Data: The Provider is not responsible for the legality of the data:

• Transferred through the VPS,

• Hosted on the VPS, or

• Accessed via the VPS.

1.3 Prohibited Activities: The following activities are strictly prohibited:

• Hosting or distributing illegal content.

• Engaging in spamming or other unsolicited communications.

• Conducting network attacks or attempting unauthorized access to other systems.

• Distributing malware, ransomware, or similar threats.

2. Security and Data Integrity

2.1 Client Responsibility: The Client is solely responsible for:

• Securing the VPS, including implementing firewalls, antivirus, and other security measures.

• Maintaining the integrity of data hosted or stored on the VPS.

2.2 Provider Liability: The Provider:

• Is not responsible for the security of the VPS.

• Is not responsible for the integrity, accuracy, or completeness of data stored, transmitted, or processed by the VPS.

2.3 Data Backups: The Client is encouraged to maintain independent backups of all critical data. While the Provider may offer backup services, no guarantee is made regarding the availability or completeness of such backups.

3. Network and Service Abuse

3.1 Prohibited Network Activities:

• Overloading the network or servers.

• Using the VPS for denial-of-service (DoS) attacks.

• Engaging in activities that disrupt the services of other clients or users.

3.2 Service Disruption: The Provider reserves the right to immediately suspend or terminate VPS services if network abuse or other prohibited activities are detected.

4. Service Discontinuation

4.1 Termination Rights: The Provider reserves the right to discontinue VPS services at any time, for any reason, including but not limited to:

• Violation of this Policy.

• Network abuse or other disruptive activities.

• Non-payment of fees.

4.2 Notice: While the Provider will make reasonable efforts to notify the Client of service discontinuation, immediate termination may occur without prior notice in cases of severe abuse or legal violations.

4.3 No Liability for Termination: The Provider is not liable for any losses, including data loss, resulting from the discontinuation of VPS services.

5. Disclaimer of Warranties and Liability

5.1 As-Is Service: The VPS services are provided "as-is" and "as available."

5.2 No Guarantee: The Provider makes no guarantees regarding the availability, performance, or security of the VPS services.

5.3 Limitation of Liability: The Provider’s liability for any claim arising out of the use of VPS services is limited to the amount paid by the Client for the service in the preceding three months.

6. Amendments to the Policy

6.1 Right to Modify: The Provider reserves the right to modify this Policy at any time. Clients will be notified of significant changes.

6.2 Continued Use: Continued use of the VPS services after modifications to the Policy constitutes acceptance of the updated terms.

7. Reporting Violations

7.1 Reporting: Clients are encouraged to report any violations of this Policy to [Provider Contact Information].

7.2 Action: The Provider will investigate reported violations and take appropriate action, which may include suspension or termination of services.

By using the VPS services, the Client acknowledges and agrees to this Acceptable Use Policy. Failure to comply with this Policy may result in suspension or termination of services without prior notice.
